OTTAWA, Ill. – An appellate court has overturned the conviction and prison sentence of a Pekin man accused more than four years ago of causing serious injury to his young daughter.
The June 1 Third District Appellate Court ruling determined that prosecutors in Tazewell County didn’t show that Clement Kobischka, 38, actually caused the abuse of the seven-month-old at the end of 2017.
The order overturning the conviction and 20 year prison sentence on a Class-X Felony charge of Aggravated Battery to a Child indicates that there is still reasonable doubt Kobischka knowingly did it.
His attorneys claimed there was evidence the infant had the injury prior to being in the man’s care.
